A US Court of Appeal has ruled the April 2024 decision by US telecoms regulator Federal Communications Commission to reassume authority over broadband internet access as a ‘telecommunications’ service and restore net neutrality rules in all states is not within the agency’s powers.
Referring to a recent Supreme Court decision that limits the authority of federal agencies to interpret laws, the court said it no longer had to give “deference” to the FCC’s reading of the law.
While FCC’s latest federal net neutrality rules can no longer be enforced, previously adopted state-level net neutrality laws, such as those of California and Washington, remain in force.
Brendan Carr, President Trump’s pick as FCC chairman, has welcomed the decision and is reported to promise more deregulatory moves for his tenure as head of the agency.
